Terms of Service

1. Acceptance of the Terms

These Terms of Service (the "Terms") are an agreement between you and HYPERCELL TEKNOLOJİ ANONİM ŞİRKETİ ("HYPERCELL Teknoloji", "we", "us") governing your use of the hypercell-tr.games website (the "Site") and the mobile games we publish (together with the Site, the "Services"). By accessing the Site or installing or playing our games, you agree to these Terms. If you do not agree, please do not use the Services.

If you are a minor under the laws of your country of residence, you may use the Services only if a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Who we are

HYPERCELL TEKNOLOJİ ANONİM ŞİRKETİ is a mobile-game publishing company established in Türkiye and a member of the HYPERCELL group.

3. The Services

The Services include this website and the mobile games we publish, including upcoming titles such as Sort Balls and Jelly Field. The Services evolve constantly: to the extent permitted by applicable law, we may add, change, suspend, or discontinue any game, feature, or content at any time.

4. License

We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Services on compatible devices you own or control, for your private, non-commercial entertainment. All rights not expressly granted to you are reserved. This license ends automatically if you breach these Terms.

Our games may offer optional in-app purchases of virtual items or services. Purchases are processed by the app store you use (for example, Google Play) under that store's own terms and payment policies; we do not receive or store your payment details.

Virtual items are licensed to you, not sold: they are part of the Services, have no monetary value, cannot be exchanged for real money, and are non-refundable except as required by the applicable store's policy or mandatory law.

7. Intellectual property and feedback

The Services and all content in them — including games, software, artwork, text, trademarks, and logos — are owned by us, companies in our group, or our licensors, and are protected by intellectual-property laws. If you send us suggestions, ideas, or other feedback, we may use it without restriction or obligation to you.

8. Fan content

We love fan creations — videos, streams, artwork, cosplay — and you may create and share them for non-commercial purposes, provided that: your content is free to access (monetization through platform partner programs such as YouTube or Twitch is fine); you make clear it is unofficial — for example, "This is unofficial fan content, not approved or endorsed by HYPERCELL."; and it is not offensive, discriminatory, defamatory, or otherwise objectionable, and does not advertise third-party products.

You keep ownership of your fan content, but you grant us a non-exclusive, worldwide, royalty-free license to display it — for example, on our channels — and you agree to remove content at our reasonable request.

9. Third-party services and app stores

The Services are distributed through third-party app stores and may link to or interoperate with third-party services. Your use of those stores and services is governed by their own terms and policies, and we are not responsible for them. Links to external sites are provided for convenience; we do not control their content.

10. Privacy

The Site currently sets no cookies and runs no analytics or tracking scripts. Each of our games has its own privacy policy, available from its app-store listing, describing what data the game and its third-party providers process.

11. Disclaimers, limitation of liability and indemnity

The Services are provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent permitted by applicable law. We do not promise that the Services will be uninterrupted, error-free, or fit for your particular purpose.

To the fullest extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, revenue, or profits, arising from your use of the Services. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, and nothing affects your statutory rights as a consumer.

You agree to indemnify us against claims arising from your breach of these Terms or misuse of the Services.

12. Termination and changes to the Terms

We may suspend or terminate your access to the Services if you breach these Terms. You may stop using the Services at any time; uninstalling a game ends your license to it.

We may update these Terms from time to time. The "Last revised" date above shows the current version's date. Material changes will be communicated through the Services where reasonably possible. Continuing to use the Services after a change means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the Republic of Türkiye, and the courts and enforcement offices of Istanbul have jurisdiction over disputes arising from them. If you are a consumer, mandatory consumer-protection rules of your country of habitual residence remain unaffected, and you may also be entitled to bring proceedings before your local consumer authorities or courts.

If any provision of these Terms is found invalid, the remaining provisions stay in effect. These Terms are the entire agreement between you and us regarding the Services.
